The findings of the Tribunal in the twenty five (25%) protested clustered precincts shows that the officially proclaimed results in the 1st District of Cagayan de Oro was not substantially affected and there is no compelling ground to proceed with the remaining 75% protested precincts. As clearly established from the foregoing, while protestant's total votes increased from 51.208 per proclamation.

Because protestant failed to overcome the winning margin of the protestee after revision and appreciation of ballots were conducted in all the protested clustered precincts, the instant election protest is DISMISSED without further proceedings. Consequently, no award of damages may be granted to protestee for failure to prove by evidence the nature, character and amount of damages incurred directly attributed to the protestant as a result of filing demurrer to evidence.
